NYC Climate Mobilization Act/Building Carbon Emissions Law: Local Law 97 (LL97)
New York City’s Local Law 97 (LL97) is a cornerstone of the City’s Climate Mobilization Act, enacted in 2019. It mandates that most buildings over 25,000 square feet must significantly reduce their greenhouse gas (GHG) emissions, beginning January 1, 2024. By 2030, emissions limits will become even stricter—ultimately aiming to cut citywide building emissions by 40% by 2030 and 80% by 2050, means net-zero emissions by 2050 (relative to 2005 levels).
🔍 Who Needs to Comply?
LL97 applies to a broad range of large buildings in New York City, including:
- Buildings over 25,000 gross square feet.
- Two or more buildings on the same tax lot totaling over 50,000 gross square feet.
- Multiple buildings under the same condominium board exceeding 50,000 gross square feet.
While most commercial and residential buildings fall under LL97, certain exemptions and alternative compliance pathways exist, such as for industrial facilities for power or steam generation, some small residential buildings, city-owned buildings, religious properties, and certain affordable or rent-regulated housing.

- Standard Deadline: June 30, 2025
- Extension Request Deadline: August 29, 2025
- Extended Filing Deadline: December 31, 2025
- Note: Previously submitted extension requests remain valid through December 31, 2025

💸💰 Penalties/Fines for Non-Compliance
The financial implications of non-compliance can be substantial, making proactive action critical.
- Exceeding Emissions Limits: A penalty of $268 per metric ton of CO₂ equivalent over the assigned limit. For large buildings, this can quickly amount to millions of dollars.
- Failing to File a Report: A penalty of $0.50 per square foot for every month the report is late
- Making a False Statement on an Annual Report: Fines of up to $500,000 and other civil penalties.
📝 Reporting Requirements
Annual Emissions Reports:
- Building owners must submit annual emissions reports to the NYC Department of Buildings (DOB).
- Reports must be certified by a NYS Registered Design Professional (RDP) [e.g., Professional Engineer or Registered Architect]
